Committee of the few . . .

I was in attendance at the Matawan-Aberdeen Regional School Board meeting last Monday night. I can’t say I was surprised at the disgusting political farce put forth by Board President Pat Demarest. At the beginning of the meeting, Reverend Thelma Gattis expressed interest in serving the remainder of Cathy Zavorskas’ term; Ms. Zavorskas had resigned her seat amidst allegations that surfaced regarding former Superintendent Quinn’s lack of certification when hired as Superintendent of Schools and then only a provisional certificate when his contract was renewed during Ms. Zavorskas’ term as Board President in Feb. 2005.

At the beginning of the meeting, Rev. Gattis spoke to the Board about her interest in serving on the board and her qualifications. Several members of the audience also spoke in support. Later, it became obvious that board members Demarest, Barbato, Rubino, and Ruprecht had privately concocted a plan before the meeting to make an appointment that night. After some discussion, it was crystal clear that board members Kenny, Donaghue, Gambino, O’Connell and Superintendent O’Malley had no idea that the others had intended to vote on an appointment to the vacant seat in spite of the fact that formal notice of the vacancy was never advertised. Additionally, the board had not even arrived at a process to invite members of the community to apply or go through a selection according to board policy. If the other board members had proposed an appointment last night our ears would still be ringing with how “outrageous” it was and how they were not following “the process”.

Ms. Demarest, after bringing up her stale old argument about a “divided” board, forced the issue to a vote, it resulted in a 4 to 4 tie and no appointment was made. Pat, I guess this is your idea of moving the District forward. Mr. Barbato, in his support for the motion, said “people on that side of town needed representation on the board”. Frankly, I don’t know what to make of that comment, because it was an insult to the entire board, Rev. Gattis, and all community members in attendance at the meeting. What exactly does that mean? I thought board members served all the children of our community, not specific sections of town.

It is deplorable how Rev. Gattis and her supporters were deceived by a group of board members anxious to push a political agenda and create strife in Aberdeen. I hope she still applies for the open seat, and is considered by the board for her merit and service to the community.

Mr. Barbato should have informed the audience of the following:

- He did not want to support the MOST program, which was championed by the very board members described as racist by some posters on this blog. Instead, he did not attend the meeting, but was observed in the parking lot that night.

- Every year I was on the board, he wanted to cut the funding or replace Aberdeen Police Officer Darryl Richardson’s position as School Resource Officer. He claimed we could get “better performance”, even though I knew the children trusted and confided in him. Why?

- He consistently voted against giving non-English speaking parents classes to learn the English language so they could help their children succeed in school, even though we had a federal grant to cover most of the cost.

Lastly, regarding the comment made on this blog about me seeking the board seat. Next time you want to know what my intentions are, just ask.

Until last night, I had no intention of applying for the vacated seat. I may decide to do so now because of the morally corrupt display of politics and brazen attempt to divide our community that I witnessed Monday night. Yes, I fully expect you to call me a racist, anti-Semite, the recently added misogynist and whatever else you choose to anonymously post. It is the only response left for people who know they have lost an argument. Cathy, many people have told me about your destructive gossip over the past few months and I am well aware of the lies that you and other board members spread all over town about me last election. I have attended almost every meeting for five years, both on and off the board; I will be at the next meeting, so you can confront me about this post, instead of hiding like cowards behind the gossip and innuendo you purvey. I am eagerly looking forward to April 21st when most of you will not be members of the board. That will be the day the School District can really make progress.

The sad part about last night’s pathetic charade is that Dr. O’Malley, Business Administrator Susan Irons and the administration of the school district put forth a zero tax levy increase for this school budget. This is a very positive accomplishment that was lost in the political noise. I applaud you for your hard work to keep programs in place for our children and presenting a serious budget that holds the line on rising costs. Dr. O’Malley, I know that I made the right decision when I cast my vote as Board Vice-President to hire you last year.

With about $250,000.00 in salary putting the budget together, that would not be a surprise. The jury is still out on Ms. Irons, as this budget came forth with what appears to be a fair amount of expensive help.

The truth is a terrible thing. Ms. Irons is not exactly loved, within the school system.

However a zero budget increase leaves me wondering where all the money was hidden in all of the past years budgets.

What was it Arsenio Hall said on his talk show? Makes you say HMMMMMMMMMM!

Is there nobody in this town who takes the high road? The well supported nominee presented herself, it was brought to a vote, there wasn't enough to carry. End of story, unless you want to take further advantage of her humiliation to drive a wedge between the people and now the sections of our township, which is what you are doing too, by continueing to make an issue of it. Be careful, you might get your wish, and wake up a sleeping tiger!

I guess you are referring to the COMBINED salaries of Ms. Irons and the two CPAs that are now necessary to wade the huge steaming pile of crap Bruce Quinn and his lackeys have left behind!!

I hope to publish an analysis of the budget next week, however Dr. O'Malley has assured me there will be no service cuts and we will continue to invest in new programs.

I'm very excited by a budget that actually reduces spending from the prior year without sacrificing services.

This post from Ken gives credence to the reasons he sought reelection to the school board election last time, all be it unsuccessfully. I do not blame Ken as he put in the time and walked most of Aberdeen, and no one should doubt his desire and determination in that effort, as Ken faced a devious and deceitful foe in BARZA. BARZA, which most would agree is happily and finally on its last legs. It is quite obvious Ken is very involved and committed to our school district, which is why I voted for him the first time.

I am hoping that the school board in its first motion of new business gives Ken serious consideration in putting Ken back where he belongs on the school board. Ken deserves to be in a position to assist Dr. O'Malley in moving this district forward, as well as allow him to give his considerable knowledge on important technology issues and purchases.

I will also say that I am also amazed at the zero budget increase. It is obvious that if Dr. O'Malley can bring that to the public, many of us have been spot on in our very vocal criticisms of past budgets, that have obviously been rife with millions of dollars hidden away in every nook and cranny, perhaps in a Klavon or Quinn game of hide and seek from the public.

Such budgetary monies may have hidden in such a manner only to be put right back into pet projects or maybe even overly funded programs after the cursory political show, that is the supposed school budget reviews by the town councils.

It is quite obvious that number crunchers can work miracles and make the numbers seem so good and necessary. Likewise thy can at the same time have those monies be readily available and movable with little effort after the fact.

Some would say such actions and deceit is criminal. Some would say it is typical and an accepted practice. I say it is deserved of much scorn, ridicule and contempt.
The taxpayers have been deceived and worse and this zero budget may be the proof so long needed to confirm many peoples suspicions and criticisms. Having been one of the vocal few on the subjects of school spending and inflated budgets I feel vindicated today.

Yes, I am patting myself on the back today, as I and others told many of you we were being robbed for a long time. Our school spending practices and this zero increase budget soon to be presented by School Superintendent O'Malley is a small facet that goes to prove that our voices seeking accountability for a school district that spends $64,000,000.00 to educate around 3400 students, did not fall on deaf ears. The budgetary math in the Matawan-Aberdeen regional School District has not added up for a very long time.

Maybe 2+2 equals 4 once again?

I think it is is typical that people are clapping for this budget without knowing what will be cut, or how many programs will be afeected by it.

While it MAY be something to cheer about once we learn more about it, I for one won't be patting anyone on the back until I see exactly what it will cost us in other areas.

We agree. This no township planner in attendance tonight stalling thing stinks of a lawyers tricks. They are purposely delaying the vote and trying to make us not show up. People will keep coming out in opposition to this development project we are not stupid. You figure to let a few meetings go by and then you will sneak it past us. Not this time.

We were fit to be tied when the word went through the crowd that no action would be taken because the planner did not show. How convenient my wife and her friends said. One lady got up and said exactly what we were thinking. She asked if this type of thing would happen over and over again until we all got tired of showing up? Try again as we will be there next time and every person for the town had better be there that is so overpaid to attend these meetings.

Next time the vote should take place or this Mr. Kouf they talked about as we all left tonight can buy our house from us. Then he can live next to his projects. And one more thing that man on the board who scolded us and said he would rather be home is a real idiat.

Did someone tell the missing board members missing tonight to stay home from this meeting? People said we should expect that from this Mr. Kouf fellow. One man said he does this type of stalling alot. Try doing it next time Mr. Kouf.

Tomorrow morning we are calling the newspapers and channel 12 and asking them to come to the next meeting. Maybe we will call the N.A.A.C.P. and ask them if they would bring a lawyer or two and get an order or something if something else just so happens to stall this vote on of all days aprils fool day. After all the N.A.A.C.P. was with us at the school meeting too so they know how to get to Aberdeen.

We will see you at the next meeting Mr. Kouf if you got the guts.

Was the Deputy Mayor there tonight? Did she publicly express her outrage that the board members would not be voting on the R.M.C. projects tonight?

You can bet she knew people were not going to be there to vote tonight. You can bet she has been told when to not attend or to attend important meetings as well. That is how it works you see. That is what Norman does when he needs to have something important voted or not voted on. It will not work this time I hope.

I remember many years ago, sitting in the hs auditorium listening to Ed Scullion the old BA presenting a " BARE BONES " budget, that passed!! Then that spring we all of a sudden had matching funds to build tennis courts.
I was also present at the end of a board meeting when MK referred to the residents of Cliffwood as Those People.

This was pure bullshit tonight. Some of us went for coffee after leaving this non meeting. We have plans to bring signs and stand outside early and show these snakes that we dont want there projects in our area as they drive up to the next meeting. We will see all of you on 4-1-09. Hey, before rumors get started here, lets make sure we are clear.

It was the APPLICANT'S planner who was the no show, not the Township's Planner as has been stated here.

I also want to touch on another issue raised here. With so many of us in opposition to this application, why don't we all pool our resources and hire an attorney to represent our cause. I think that would be a great idea. Lawyers are expensive, but working together, we should be able to hire one without too much trouble.

Unfortunately we can't always defeat applications based upon pure numbers. While we are true and just in our cause, the reality is this is a legal proceeding and although we may no want to admit it, none of us really understand the law.

I think we will all be sunk if we don't get together and hire a good attorney who understands zoning board law and can make a real legal argument as to why the application can not be granted.

Lets review. People came out in large numbers against an applicants low income housing project at the last meeting catching everyone off guard. People are told the meeting will be continued for another two weeks. Two weeks pass. And people are not supposed to be shocked, disappointed and surprised that at the very next meeting an integral player just so happens to not show up. Any of you who think this was not all planned in advance interested in buying a bridge that connects New York and New Jersey for a really cheap price?

The application is for a variance to change a piece of property that is not now or ever been zoned for multi-family dwellings.

Go to town hall and ask them to show you another large piece of property in all of Aberden where a 138 or so multi-family unit was granted such a variance. Then look and see who was the lawyer for the town at that time and who was the lawyer for the developer for any such granted variances on any similar development.

History does repeat itself and so does legal maneuvering, which is then usually tied to political corruption.

All I can say is that I went to both last nights meeting and the school one. You people in your comfortable chairs behind your tables looking down at us need to know that we are not going to be quiet any longer. Get used to it or get the hell out. I have read several past subjects and all I can say is when you knock on my door. I have more then a few things to say to anyone wanting my vote.

First they insult some of us at a school board meeting. Then they insult more of us at a development meeting. What is next? Are they going to come into our homes and smack us all in the face? The school meeting and development meeting did that to us by thinking we do not matter. Think again.

To all of the candidates running in November you will not be getting an awful lot of votes from us. That is another thing from last nights meeting that I almost forgot about. Thanks to Mrs. Gumbs for not standing up and saying something on our behalf. So much for our candidate.

I was totally mortified by the "North and South" comment and if that wasn't bad enough Mr. Barbato refers to the audience as "these people from that part of town", I think anyone in that room should have been insulted by what happened there.

She seems more than qualified? Once we go through the process, what is wrong with her?

I think everyone should have a chance to state what their experience is, what road they'd like to help take the school in, answer some questions... and then have a vote on it.

Seems like both of these people would make good BOE members. And maybe there are others who would like to be considered.

I don't think anyone should just be handed the job without a chance for anyone interested to step forward.

No one is looking for any type of division as alluded to in the above posting. People basically want a fair and open process based upon democracy.

I think, the reason everyone is so angry, is because the "democracy" part hasn't been happening in this town for a long time. A small handful have been calling all the shots.

Many years ago, I first heard the comment: "This is not America, it's Aberdeen" I think that sums up how many residents feel about what goes on in this town and with our school district.

Hear, hear! to above posters. I agree we all should be equal, perhaps now that there is going to be a big change on the school board and hopefully in the town council, we will be. There have been certain people who have used their positions to promote division and discrimination in the district and town but I feel optimistic that people see them for who and what they are now and want to heal.

Lets lay the blame where it lies and come together to say no more!

As for the Reverend, she seems genuine and if she goes through the selection process, there is nothing wrong with her being chosen on her merits.

I find these posts very interesting. The problem is we need to come together as a "united town". I live in the Cliffwood Beach section of Aberdeen, but it is Aberdeen people. There is no town of Cliffwood Beach, it is Aberdeen. The people in the Strathmore section are not better than me and I no better than them. When I vote it is for Aberdeen, not Cliffwood, when the police are needed it is the Aberdeen Police, there is no Cliffwood PD. Let's grow up!

Whatever the outcome of the board vote be ready for the lawsuit sure to follow. That is also how Normy works. People oppose the development then the board vote is split, then let the lawyers make money fighting over it. That means Normy makes money from the town legal people who will then represent the town against the developer. Either way Nnormy makes some more money. Right Normy?

There is no town of Cliffwood Beach, it is Aberdeen.


I wish this were true for everyone in Aberdeen. But as long as there are people who call us "those" people, superintendents who talk about the Cliffwood parent's crack pipes, and parents who won't let their children go play "over there" for play dates, it'll be hard to not feel the divide between the areas.

Are we all the same? Of course. Does everyone seem to realize that? Sadly not.

Ok anonymous above who refers to the Norman making money regardless of whether the Board approves the application or not?

What is your suggestion? Would you prefer the Board votes down the project and then have the applicant sue and the Board not defend the suit so that Norman makes nothing?

Would that make you happy? I personally don't care who makes money on this matter as long as it involves no Section 8 development going up in Cliffwood. If Norman makes money from that, why should I care?

I just remembered when last I checked the County Road property was not zoned for housing for families. I remember that from a while back when they wanted to put something else there. Somebody needs to check that with the lady from the town.

We all need to fight this now or if a lawyer pushes the plan after the plan is not allowed for housing. We need to remember this is politics and they will be looking for our block of votes real soon. They build no votes. That they will understand. I also agree with the other letter that Ms. Whilemina should have said something for us.

Damn right she should have spoke up for us. Maybe she was being a realtor that night and thinking about how much she could make off that number of houses. Her silence was disturbing to me. My wife not so much. Maybe she got a payoff from them to keep shut. My wife says at least she showed up. I wonder what happened behind the scenes to keep her so quiet.

Everybody has a price and we know politicians will just demand the amount of money they want from a builder to not interfere or to maybe guarantee the approvals. Maybe that happened? I only am left to speculate since she said nothing while we were all there looking to stop the projects from being built in her area of town also.

First of all let's all be clear on something by law the board must hear all applications. Don't let this issue now divide us. First of all if you said Ms. Wilhelmina you must know her pretty well and do you think with all the fightning she has done for Cliffwood along with Mrs Macon organizing the concerned citizens she would turn her back on this. She is the Deputy Mayor the applicant possible can sue Aberdeen becuase she influence the board. By the way call her and asked her how she feels. Remember she lives on County road. Don't let outsiders influence the progress that has been made in cliffwood, we have come a long way. When no one was fightning when drugs were sold on the corners and sneakers hanging from the telephone wires some years ago, just remember the meetings at St Mark Church the pressure that was place on the police.What a difference it makes when you stick together to make positive changes. Mrs. Gumbs was there and that should tell you how she feels.

I happen to be an attorney, so I can answer your questions, although I do not know the answer to # 3.

1. I will confirm a Zoning Board can not legally refuse to hear an application. The Zoning Board is like a Court of Law. A Court can't refuse to hear a case that is brought before it. If you file a lawsuit, the Court has to hear it, regardless of its merits.

Likewise, the Zoning Board has to hear any application that is brought before it. That doesn't mean the Board has to grant the application, but it definitely has to hear the application.

Planning Boards and Zoning Boards are actually required by law to deny applications when the applicant hasn't met the required statutory proofs for obtaining variance relief pursuant to the New Jersey Municipal Land Use Law.

If anyone tells you that a Planning Board or Zoning Board can actually refuse to hear an application simply because the Board members don't like the application, then that person really doesn't understand the law.


2. The Mayor, or anyone else for that matter, is free to speak before the Zoning Board. However, as a practical matter, the Court would not look kindly if a council member spoke against the application on the record. It would look like the council exerted its influence to defeat an application.

3. I have no idea what the connection, if there even is one, between Kauff and the applicant.

I know you were looking for a response from the Aberdeener, but since its Friday night, and he is a very observant Jew, he won't be able to respond until after sundown tomorrow.

I am sorry, but I agree that the cliffwood and beach sections are not thought of as equal in comparison to areas near 34.

There are glaring differences in services provided. And let us all wake up- the redistricting years ago wsa fought tooth and nail because of where certain people's children would going to school.

It is wrong but no one will admit it. I am proud to say my kids go to school in all sections of our town.

Let us see how see how the new board cares for all parts of our Mat. - Ab.

I seem to recall that one or two industrial addresses on County Rd are listed as either toxic Superfund or Brownfield sites. I don't know about you, but I don't think people should be housed on toxic sites, no matter how low or high their incomes!

Just read the post and the three reasons given to exploit racism and Mr. Barbato need to be examined a little closer.
The jury is still out on the effectiveness of the MOST program. Maybe a good program, maybe not. It did cost over $10,000.00 and it is too soon to tell.
Can we get better performance form our resource officer. Most would agree that we could do better and just because the officer is black should have nothing to do with it.
If a federal grant covered most of the cost of English to adults it is not unreasonable for them to cover the remaining cost in these economic times. Either way federal or not the taxpayers are on the hook for this money and to ask the question is not unreasonable.
This was a weak attempt to exploit racism or make someone appear racist. These programs should be questioned just like many others.

My thanks to the attorney who answered the questions regarding the zoning board.

As for Kauff and the applicant - The applicant is RCM. RCM is owned by Rick Ciffeli. Hence the name - Rick Cifelli Management.

Cifelli is the largest local developer in Aberdeen. The assumption is that you don't get to become the largest developer in Aberdeen unless you have an understanding with Norman Kauff. However, though I've heard the stories, and they have certainly received variances that I wouldn't have approved, I have not seen any documentation linking the Cifellis to Kauff or the local democratic party.

As for the Zoning Board, this application was first reviewed over 16 months ago. There is an obvious effort to delay a vote on the project.

Also, as the attorney noted, the applicant is required to demonstrate the request meets the legal requirements to receive a variance. However, the board is permitted wide discretion in determining whether that legal standard has been met.

I agree with most of what you just wrote, but let's clarify one thing you stated so as to make sure we are keeping the facts straight.

The application currently before the Zoning Board is a very different one than was presented 16months ago.

I completely agree that what happened on Wednesday night was an inexcusable delay tactic on the applicant's part, but I just want to make sure everyone understands this doesn't equate to a delay of over 16 months.

If this was the exact same application as was presented 16 months ago, then I would agree the delays have been tremendous. Instead we have a completely new application.

So while Wednesday was most definitely an unfair delay, I want everyone to keep it in the proper perspective. If we don't, we'll have people yelling at the Board for hours at the next meeting that the application has been delayed for 16 months and then we will never get anywhere.

I personally want this application be done already. Hopefully the Board will see our view and deny the application. We won't get anywhere if we are yelling at the Board Members insinuating that they are in cohoots with the applicant. (By the way, I'm not saying anyone has done that, I just want to make sure it doesn't start happening)

Lets try and keep ourselves to facts. If we do, I'm sure we'll win in the end.

The application is not so different from 16 months ago, except in 3 respects:

1. 16 months ago the township planner and township engineer recommended against the project.

Now they support the project with the same housing density and now it is okay to give up valuable commercially zoned property.

2. 16 months ago the applications were for economically integrated housing that met COAH standards, meaning that 20% of each project would be "low-mod".

Now one project is market-rate and one project is 100% affordable "low-mod" housing.

3. 16 months ago the town's Planning Board did not support the project.

Now they, with council's blessing, have ammended the town's comprehensive plan to undesignate the land as commercial.

Some things stink, and this thing sticks like a dead skunk in heat. Long live Kauff!

This was not the applicant's delay tactic at the last meeting. It was engineering my Kauff to make sure that he can get these loser projects past the board. Wake up!

Instead of that happening, the use being proposed is still not an approved use which means the applicant has a much tougher burden toward establishing its application will be approved.

My money is on the RCM application being denied. Just wait and see. And then we can sit here and laugh at you all.

Of course, once RCM goes down, all you know it alls will just sit there and say "Well obviously RCM must not have paid Kauff enough."

Contrary to what you wrote, the truth is the only public body that can legally re-zone property is the Township Council. No one else has that power.

The state legislature and our state courts have made it clear, time and time again, that zoning power is exclusive to the Township Council since Council Members are elected officials and therefore responsible to the voters for the manner in which they've chosen to zone their municipality.

You can pretty much check this fact with anyone who understands anything about zoning. Its pretty much the most elementary rule in zoning, so I'm really surprised you didn't know it, or, if you did, I have to question why you would deny it?

The person in the second to last post before this one has a limited knowledge of zoning law.

While it is true that it is the township's responsibility to rezone, that is responsibility is limited under the law. In NJ, builders can seek redress in the courts if they can make the case that a town's zoning is "exclusionary" (i.e. is written to disallow affordable housing).

One of the problems that the council has created with the two Cifelli developments is that they supported modifications to the master plan which supports development of housing in those two areas that are currently zoned for highway commercial. Now, even if the zoning board votes against the development, Cifelli can sue to have the court reverse that decision because it may be inconsistent with previous council action.

In other words, like with the cell tower issue, they can sue and stamp their feet is defense of residents, but they are likely to get overruled because their protest, now in front of voters, is inconsistent with past action that said water towers are ideal locations for cell antennas.

This council has knowingly set itself up to have any action it takes now against the developments called "arbitrary and capricious". Pretty cool trick by Kauff -- his attempt to have council members be for it and against it at the same time, depending on audience.

It is really quite sad that so many of these people have sold out to Kauff. Fred Tagliarini, on the council and on the zoning board, is complicit in maintaining council's "we see nothing, know nothing" attitude.

He joins Raymond, Sobel, Drapkin, Gumbs and Vinci in pure allegiance to Kauff and his campaign dollars. So sad. So sad.

Speaking of costs does anyone know what the costs were to correct the C.M.E. screw up on Gerard Avenue? We are about to start playing and every time my kids play and we have to park our car on Wooley Street the neighbors will give me and my kids a look as if they own the street. It would have been nice to have been able to park across the street until as reported here that C.M.E. screwed up big. Did they pay for the screw up I wonder? I guess no action will be taken against the company and its just another inconvenient cost borne by us the taxpayers.

I would have a real problem with him running for office under the Norman Kauff umbrella of deceit and corruption. If he runs with them he runs alone. No way I could vote for the man even though I think he has done a great job for many years for the citizens. It would be very disappointing to me and my family as we have counted on him often over the years. It cannot be true. What could Norman Kauff do for Mr. Lauro that would entice him to such a thing knowing what he must know about Mr. Kauff?

Looking for a new topic this morning and make the following suggestion. Mr. Lauro cannot run for office since he is an employee of the town.
I think that is how it works in N.J. just so you know. Train time go to go.

Train time may be right. But it would be very disappointing to me if Jimmy Lauro ran for office. He really needs to rethink that one.

Mr. Lauro is widely expected to announce his retirement in the next two months.

That is a shame. Mr. Lauro is a big part of Aberdeen. Is he being pushed out like Janice Gallo was? Who is pushing such a fine man out of his job? Aberdeener check this out if you can. This Norman person seems to stay around like a cockroach but Mr. Lauro they show the door.
