Setting the Stage for Union Negotations

Considering the MRTA’s declaration of an impasse, not to mention the superintendent’s and business administrator’s imminent departures, it would appear contract negotiations between the Matawan-Aberdeen school district and its teachers union are on hiatus. That would only be technically true. The competition for public opinion is afoot.

The first volley was lobbed by the teachers union in its condemnation of the “wasteful” spending in Board President Kenney’s communiqué as to the status of negotiations. Sadly, the union’s cry of waste is particularly hypocritical in this instance as it was the union’s actions and history that necessitated the letter.

During the last negotiation, MRTA President Kosmyna had complained of “working without a contract”. That was not true then as any similar claim would not be true now. Under law, the teachers continue working under the “expired contract” until a new contract is in place. Practically, there is no difference for any school employee between an expired contract and an un-expired contract.

Given the union’s decision to declare an impasse before negotiating any terms, the school board naturally assumed the worst and chose to pre-empt any miscommunications from the teachers union.

(Note: The following two paragraphs were slightly edited to note a staff member's "step" on the salary guide is frozen under an expired contract.)

The next charge from the teachers union will likely be the teachers aren’t receiving any raises. Well, that's true but not the whole truth.

Once the new contract is settled, teachers and other staff qualify for two raises – moving up the salary guide and adjustments to the salary guide itself. (Though it's a subject of negotiations, those raises are often retroactive.)

Taking this year as an example, let’s say the salary guides for all employees are frozen for one year. In the common parlance, this would mean the staff is getting a 0% salary increase.

But that 0% only applies to the guide itself, not staff moving up the guide. Even with a 0% increase, the staff units represented by the MRTA would receive the following average salary increases during the 2010-11 school year -
Teachers – 2.1%
Clerical – 5.8%
Drivers – 3.6%
Maintenance – 2.2%

To be fair, this doesn’t include the 1.5% employee contributions to healthcare but, to be fair, was it ever fair that teachers didn’t have to contribute to their own health care?

Remember, the above increases assume a 0% increase to the salary guides. Any negotiated raises will be in addition to the above. (On a side note, the teachers union has already conceded the above numbers during negotiations.)

However, if the school board hopes to garner public support, they need to let the public know what’s at stake. For example, one of the board’s priorities is the elimination of “past practices” and a relaxation of work rules.

For instance, the school district must pay a fee to any union officer who is required to proctor his final exams to his classes because proctoring exams does not qualify as a “teaching duty” and the teachers contract exempts union officers from non-teaching duties.

Another example is when the union leadership advised teachers to no longer help children on and off school busses without compensation. To the teachers’ credit, they ignored the recommendation and placed our children’s safety first.

Then there was the question of whether teachers had to be paid extra for analyzing their classes’ assessment scores during school hours to determine how to improve their curriculums and class instruction.

And the list goes on.

This is a public relations campaign the school board needs to win. Remember Marlboro.

On a final note, the school board should inform the union leaders that intimidation tactics and/or a work slowdown will not be tolerated. In addition to further outsourcing, the board has two other arrows in its quiver - the infamous “custodian email” whereby the union threw the custodians under the bus and the case of employee theft.

For a number of years, several teachers, including union leaders, received compensation for work never performed. I uncovered the fraud two years ago but was asked to keep it quiet. Dr. O’Malley immediately halted the practice.

Considering how widespread the practice was and how several administrators were in the know, I don’t foresee any criminal charges, but I wonder how eager these teachers are to have their records permanently stained with the label “thief”. All the information is public and the payouts were part of the board agendas. But nobody had bothered to check if the work was actually being done.

Labor leaders are expected to fight vigorously on their members’ behalf but intimidating board members and poisoning the school environment are beyond the pale. The school board should let the MRTA officers know that unacceptable behavior will have consequences.

Under the existing contract, they automatically move up one step unless they're already at the top.

You are wrong. When the contract expires everyone is frozen at their current step. They do not move up the guide. If you were still on the Board, you could call the payroll department and compare anyone's salary from last year to this year. You would find they are identical. Now that you know you should revise your post.

On the fraud you uncovered, who asked that you keep it quiet? Who was responsible for checking to see if the work was being done before those teachers were paid? Why isn't the money being paid back? You say administrators were in the know, were they reprimanded and made part of that administraotirs record? Please respond to these four questions?

Don't want to give names (and I don't believe anyone was reprimanded as the entire episode was kept quiet) but I'll tell you how it came about.

I had submitted an OPRA request for certain documentation that was related to payouts the school board had authorized. Under the school board attorney's advice, my request was denied. I then threatened the school district I would sue for the documents.

At that point, I was quietly informed why the documents couldn't be made public and I was asked to not publish anything.

Given the nature of the fraud, I suspect that several administrators and many teachers must have known what has happening but said nothing.

You didn't fully revise the post. If the Union and the Board do not settle this year, then there will not be an increase at all. Your post makes it appear as though the union members are receiving a raise this year. That is not possible unless there is an agreement between the two parties. Your post should not show a percentage increase for any union member for the 2010-2011 school year since wages are frozen to the previous year under an expired contract.

The steps did not come to fruition THIS YEAR because the teachers are working on last years contract and last years numbers....


THere is no RAISE this year of any percent because there is no new contract......

Aberdeener is right, according to a former board member that I asked today. She has been a member for several years and said she dealt with negotiations a couple times. Her take on the whole circle talking tactic is that the union does stuff like this whenever they are negotiating and an expired contract does "freeze" % BASE SALARY raises but THEY STILL GET THE STEP INCREASE as they move up the steps.
Also I hear that O'Malley's girl pet, Deluca, is telling anyone and everyone in the main office that she will be getting his job when he leaves. I sure hope the board is not going to roll over on the replacement search just because she is his girl.

After all Aberdeen is run from that location anyway.

Agreement calls for retroactive pay, zero increase for 2011-12

After several months of negotiations, the Holmdel Board of Education unanimously approved a four-year agreement with the Holmdel Township Education Association (HTEA), a document that includes a zero percent increase for HTEA members for fiscal year 2011-12, on Nov. 17.
The two parties signed a memorandum of agreement (MOA) on Oct. 27, which was ratified in a final board vote last Wednesday evening.

“This is a fair settlement,” said board President Ray Tai, before voting yes on the agreement. “I appreciate the effort that the HTEA representatives have made. It’s a long process, but it takes time.”

Under the MOA, members of the HTEA will receive a retroactive 3.5 percent pay increase for the 2009-10 school year, a 2.9 percent increase beginning in the middle of the 2010-11 school year, a zero percent increase in the 2011-12 school year, and a 2 percent increase in the 2012-13 school year, according to a statement from the district.

Tai explained that the new agreement establishes “fiscally prudent obligations” for the next two school years due to the zero percent increase next year for HTEA members.

“It is also revenue-neutral, since it does not adversely impact our current budget and aligns with the pending requirements of a state-mandated 2 percent cap,” he said in a statement.

The contract between the HTEA and the Board of Education expired on July 1, 2009, and both parties entered negotiations, mediation and fact-finding, a legal mediation process.

With no contract in place, HTEA President Denise King previously stated that members of the teachers’ union worked according to their 2009 salaries.

As part of the overall MOA, the district decided to grant HTEA members a retroactive salary increase for the 2009-10 year because the district set aside funds under its $56 million spending plan.

In addition, several changes have been implemented under the new agreement, including longer school days and class schedule modifications. Instruction time at Holmdel High School (HHS) will increase by an extra 60 to 70 hours per school year.

So tell me, why is my high schooler coming home telling me about the "poor teachers" working without a contract, and misled by the teacher's remarks and hearing about all their woes, AND STILL COMES HOME EVERY DAY WITHOUT HOMEWORK! I guess teachers are only interested in teaching kids misleading info the union wants to spread, and not the actual curriculum.

In regards to the pool club I was told that the approvals are still being sought. Something about approvals for traffic in the area. I think there is little the town officials can do in light of that as it is a construction site. I myself asked about the same property a little while ago as I am also unhappy with the property.

Say what you want - but as a negotiator in another field - I will tell you that if you take out RETRO pay, then why wouldnt a BOE stall negotiations EVERY 3 YEARS so they could keep the money?

It is the only way teachers can keep a somewhat fairness to the process because you know that would be a way to keep money every 3 years....


And I love how the anonymous complainers about teachers come on here - no homework? teachers complaining? Work slow down? Come on - get real....if I am not mistaken the MRTA has not gotten a contract on time in several 3 years cycles in a row now so I am sure they are used to it.. or better yet, put a name to your complaints or call the school your kid works at and complain....I dont think you will

I never said it was wrong to get retro pay, we all know they do, so why are the teachers speaking as if they don't. My complaint is why are teachers complaining to the kids on class time, when they should be teaching.
Why are you leaving out the union's part in delayed contracts? They also declared an impasse.
Do you have kids in this district? Are you happy with their lack of homework? And yes, I do speak to the teachers about not enough homework. So don't make assumptions.
My concern is, I would like my children to be able to compete with the rest of the students from better school districts for college acceptance. What good is my child getting an "A" in a class where the teacher is too lazy to actually teach. Don't think it hasn't happened, it has, several times.
Lastly, Thomas, don't think you are not anonymous, you are, I don't see your last name or address identifying you.

I thought I've read one of your statements stating school policy had been changed so that homework is actually graded on accuracy. However in speaking with several of my children's teachers, they still say it is only graded on effort if a kid hands something in, no matter what is written, they get 100% for each homework.
Also, am I the only parent that thinks it is absurd to give a child, first grader to H S senior, 100% on a homework grade for COVERING A TEXTBOOK at the start of the year, or signing a teacher's class procedure letter, which of course, is then never followed by the teacher themselves.
Policy might have been changed, but if so, the teachers aren't following it.

Previous posters mentioning Holmdel contract and retro pay need to understand that OUR union is NOT their union. Our union makes it standard operating procedure to declare impass without really negotiating the hard stuff first, declaring impass as soon as they are faced with negotiators who are not going to roll over and give them whatever they want, whining about not having a contract when they do all they can to drag out the process, posting whining signs about "working for your kids" in their $50,000+ cars, staging sick outs (been happening at middle school since last year), scaring kids and families with lying propaganda, burden kids with their personal tales of woe,waste taxpayer's time and money by filing greivance after greivance against the district,demanding the district increase the tax levy to the maximun allowed so they can get their money without giving anything back and with no regard for the very real struggle of taxpayers to pay outrageous taxes each year, send teachers of board member's children to stand outside their homes to 'protest' with no regard for the emotional damage to the kids(but they are all about the children??, over run board meeting where little kids are to be recognized (but they are here for children), behave in a manner that would not be tolerated of students, subtly and not so subtly target the children of negotiation committee members, lie to their own membership about their "attempts" to "negotiate" for them,make sure to keep the lion's share of any settlement for themselves while only giving newer members a couple hundred dollars a year, engage in back room deals with certain board members while in impasse, and on and on. And now, let the ugly, angry replies initiate! I have no interest in having to "prove" what I say or post under my name, until teachers and union thugs do the same. As a taxpayer, I say NO raise, NO retro pay,and frankly, NO settlement until these blood suckers give some back and start spreading the wealth to the young teachers who actually still WANT to teach and LIKE kids enough to CARE if they learn to read and make it out in the world. So, now BRING IT ON, union creeps, I happily await the inevitable slew of ignorant, self-important, poor me, greed provoked insults.
P.S. PLEASE spare me the ridiculous whining about O'Malley an Iron's raises, old news and when teachers get the proper degrees and certificates to be a BA or Superintendent, then they can make a comparison to their job and responsibilities and those of an administrator. It is apples and oranges. Can't run a district without those positions and based on the sickening bellyaching teachers give us over the least thing, they could not handle the daily pressure anyway.

I had argued against the old policy of forbidding teachers from grading homework but I don't know what the new policy says. (I don't recall having voted on homework policy.)

However, I can tell you I argued with one of the principals over allowing teachers to grade homework and the principal was adamantly opposed.

This district makes no sense.
Let's not grade homework so kids and their parents actually see how much of the work they understand. And they could work harder to get the rest.
Let's wait until the quiz or test, so they can do poorly on the test, have that grade on their record, never be asked to make corrections to the quiz or test so they can finally get the material, and then move on to the next chapter, without understanding the previous work first.
And then we wonder why 1/3 of our high school juniors didn't pass the HSPA. Is everyone so dense not to understand that language arts and math builds upon previous knowledge learned, and if the material isn't fully learned, the kids are always going to be falling further and further behind.

I saw Mcaleer coming out of town hall today and asked him about the pool club and the anchor glass properties. He confirmed the previous information supplied about the reasons for the delays with the pool club. On the Anchor Glass place he said that is finally a ratable for the town for the past couple of years and is finally helping the town with taxes. Go to the source and you get the answer I guess.

I don't know what teachers your kids havge but my 3 kids get HW almost every night AND it gets graded. I check the portal every week and all HW has grades.
They have never come home and said anything about the teachers working without a contract. (I just asked 1 of them) He said he knew thewy didnt have one, but never heard about it except when he heard me and his father talking about it.

When any public servant does not have to pay a deductible for his medical insurance, nor his prescritions nor premiums, I'm sorry but that just isn't right. Public servants should have the same guidelines as those in the private sector. This guaranteed job is just BS.

Even the Matawan Police Dept. worked with the Borough when it came time for salary negotiations. Social Security has not given the elderly a cost of living increase for two years. Are public servants better than the rest of us?

The police in Matawan negotiated to help the town more then once. They have changed their insurance plan two years ago(yes they pay deductibles)and opened their contract and gave back thousands of dollars last year. Yet, the town has comeback after the police supported them and are laying off 2officers. Hey Bucc your doing an amazing job. Lock the doors and turn it over to Aberdeen.

There is a very truthful letter to the editor type letter in the Asbury Park Press today. The resident named is Susan Bergman. She states that Aberdeen spends over one third of our entire budget on police services. While I find that a necessity I also think many communities also have been far too generous or overburdened by police unions by the veiled scare tactics they threaten politicians that our safety will be jeopardized if even one police staff person is cut.

Union representatives like the police have with their considerable funding sources, hired gun legal eagles as well as political power over scared elected officials is likewise a mixed bag that ends up costing taxpayer a very tidy sum for votes. We also have to applaud and support changes to binding arbitration that has cost communities greatly for too long now.

While I am a renter I do see the police response too often in my own complex. While I also see the quick response I do feel that town leadership must make the tough decisions to review the police staffing levels and prioritize all town personnel and services are ensured to give taxpayers the most for the money. I respect greatly the people who wear the blue or black uniform very much. I think priorities have changed in these economic times and our politicians need to make decisions to ensure all services that a town needs is given proper consideration in the end.

My own cousin worked in Matawan until recently and tells me that cuts made there will leave the town without important services. It of course may not serve the residents well in the short term either as winter approaches with snow removal needed. This is partly due to police costs he said and the self serving political decisions made in Matawan as well.

While we do not live in Trenton, Camden, Newark or Plainfield our community leaders need to prioritize, ensure all critical service and of course stop the political friends from being bankrolled. It is said political friends are too often the main concern of our politicians and their mysterious handlers when important decisions have to be made. In Aberdeen the political handler is said to be a man most of us have never seen. Those elected leaders who may allow such a person to be the one to make important decisions are not serving the electorate properly. I for one did not see this mysterious handler at the tree lighting the other night or at the towns day at the high school during the fall. That mystery power person gets much play on this site so before even one of our employees get cut by our council people who may need to streamline the services we all need. They need to be fair with all that a community requires and not one service more than another as was highlighted in my words and in the newspaper today.

As Ms. Bergman pointed out the police are a big portion of taxes and while they are very necessary many other services we need are no less important for the whole of our community. I respect our police but feel our leaders need to be held out to make the truly tough decisions without possibly being told what to do from the dark unaccountable political power bases.

How quickly we forget that the municipal budget in Matawan is really not large at all. So 1/3 of that is not bad for 24 hour 365 service. Lets also not forget whatever cousin that worked in the public works section is probably one of the people that forced the borough to have all road work done by outside vendors because of union threats etc.... This has cost Matawan borough MILLIONS of dollars. The schools are the problem and no one wants to take on the problem.

Yeah they reviewed a $100,000.00 plus salary sitting at home while officers that actually do work are losing their jobs. So if my math is right the police lose 3 positions. That can not be good in a small town.

Lest we remember why Matawan Township changed their name to Aberdeen. Money thats why. There will never be a consolidation because it will never come to terms, remember the railroad station development that was supposed to be completed years ago, both sides can't agree on any and all facets of the design, housing, retail, etc. These two towns do nothing but get into a pissing match everytime they have to be included in something and granted, we don't get enough for the municiple end of our taxes, it is the schools that are killing both of these communities and the district does not have the balls to address it like it should. Fire every teacher when the contract is up and start from scratch at reasonable wages, do away with tenure and be rated on test scores. Bad scores and your fired. Those teachers that do care and do teach have nothing to worry about, those teachers that sit on their ass and collect a paycheck will get fired.

For the past couple weeks my neighbor who is a teacher at the High School has been telling me how that new assistant superintendent that was hired a few months back is the person the teachers want to take over for Doctor Dick. I never say anything when she talks but she statrted in again yesterday and now she says that it looks like all that lobbying they are doing is working because she heard that it is "a done deal". Well, I just could not smile a nod this time. As I said to her who is this person? why is it a "done deal"? if there is a search supposedly happening for the job, and pardon me for saying so but I dont think I would want someone being handed that important job at the highest salary in the district just because the teachers want it and the board is afraid of an uprising if they don't get thier way. I guess nothing much has really changed after all.

Yes, this district is worse off than before because of the timing of when they are leaving and bad contracts. The two people that were hired were only using this district, and had no loyalty or committment long term. You gave them everything they wanted and that still wasn't enough. That is poor management in the selection and compensation process. The Board of Education and its members are to blame for these choices and now we pay the price for many years to come.

I was just looking at the salary guide on App.com for Matawan Aberdeen School District. I can't believe that people actually complain about the fire and police salary. There are an astonishing amount of teachers making as much as the Chiefs of police in the very nearby towns. I believe that a chief of police has far more responsibility and liability then any teacher in the time and day that we live. Yet the fire and police salary is the first to be complained about.

Your badge is showing to the anonymous poster above who was posting about teachers salaries versus police salaries. First off both were underpaid and that has changed greatly from years ago. Ask yourself why a police department the size of Matawan cycled chiefs out so often and only after a few years in the top spot each. That is very costly and often unknown to many. So too is the hierarchy and quite often the too heavy brass positions in many towns. Our own politicians and most others in small towns and big cities alike have caved to police union pressure just the same as school boards for too many years. The costs are high for the taxpayers. Please don't cry for most of your local police officers as they have often been given more in pay, benefits, medical packages and more than their fellow employees that they work beside. How fair is that or beneficial to employee morale when is non existent except to the police. The police work schedules also have hidden costs that quite often allow for a second job and also have with very generous comp time rules, shared overtime coverage for their fellow injured officers, construction traffic jobs, vacation schedules that are also costly to supply manpower to cover those shifts with costly overtime rather than adjusting schedules by management. This also brings into question stressed police coverage and promotes overworked or underutilized staff that may not be cost effective or fair to the department itself or the community it protects. I will no doubt be attacked for my words so when you attack me it better be with real facts not just bravado and stories about wearing the badge and gun. To thy own self be true before you attack my provable points and that which most officers know is the absolute truth. The blue line isn't what it used to be so bring facts not war stories to this retired flatfoot who was walking the beat when most of you were in diapers. This is Matawan and Aberdeen not Fort Apache in the Bronx. Those were the mean streets where the gun and the badge meant something.

When I take my kids to your place of employment (we'll use Mc Donalds as the example) and buy them a Happy Meal, I pay for it out of my, as you put it, tax payer funded salary. Please with this services BS in the schools. The system is exactly the same as it was 20 years ago. Same kids, same teachers, and same ol Sh*&t. Its the school board that allows all this wasted $$$. I will agree there are a ton of extras now like a ridiculous amount of babysitters (aids). Oh and from what I understand smaller classes and alot more teachers yet the test scores suck. That also sounds like alot of wasted money. A nice new very expensive football field and lights. Thank god we have those although the blessed players only use those on game day cause the now pushover of a head coach allows the star players to miss practice and play anyway on game day. Like the player that was making death threats in school (brushed under the rug by that same coach) also didn't show for practice on the Friday before the Manasquan game. Guess who played against Manasquan without any discipline? That would have never happened lets say between 23 and 16years ago. It doesn't matter now though being that the season is over. Right? Yet that same coach makes hundreds of thousands of dollars and is never reprimanded. I hope the rumor is true about that letter. This school board are nothing but kittens (being nice). Heres a tip, get Valentino back on the job also cause a few of those younger coaches are recruiting from outside to make another run for the championship. This will cost the tax payers more money.

If that is true about the coach letting players take advantage because of star power, then maybe it was poetic justice that they lost. This coach has been protecting his star players for years with his powerful position, nothing new here. What is more disturbing is the fact that Manasquan claims they were motivated by taunting before the game even started. If that was allowed by the thug coaching staff, then the loss may well be deserved. Does anyone know if any of that is true?

Its all true every bit of it. Matawan Football is hated throughout the Shore. I don't know where it went from tough beat down Matawan Football which for the most part played with respect for there opponents for years. Now just a bunch of thug gangsters on the sidelines which in turn plays into the heads of the young players and then they want to be gangsters. Ask the backup quarterback from last year. Refered to as white boy by a volunteer coach that may or may not have been the father of one of the players. Sick and disgusting. None of these kids will make it in the game and maybe at life either. Once they findout the difference between Matawan High School and the real world

The Quarterback on Rumson-Fair Haven is Mike Villapiano. His father is Phil Villapiano. Look him up. He knows football and was a very good pro player, he has a super-bowl ring from the Oakland Raiders to prove it. I think he knows how to watch game tape and put together a defensive game plan. Matawan was overconfident, got out coached and stopped cold by a good defensive scheme.

What Joey and his assbags, as someone said, allowed was approving the AD to also be football coach. An outrageous AD (administrator) salary and a stipend for head football coach. No where but here is that allowed. Time does not allow for both jobs and everyone knows what his priority is. Thug coaches, bad reputaions, double dipping. Shame on you Joey, after playing the advocate for what is right.

I don't expect you to know my record but you should at least have the humility to say acknowledge you don't know it.

I was the guy who raised the issue of the AD recommending his son to work at the games. His son was then removed from the roster.

I was also the guy who tried to change policy to prevent an admin from interviewing candidates and recommending appointments when that admin was seeking the very same appointment for himself. I think the vote for that change was 7 nays, 1 aye, and 1 abstention.

During my time on the board, the board members only received one complaint against the head football coach and one complaint against the head basketball coach. In both instances, the community clearly wanted both men to remain in their positions.

In both cases, considering all the circumstances and community support for the individuals, I strongly supported keeping them in their current positions.

We should all exopect our taxes to go up next year, gorilla Joe needs to win another championship, to make up for the won he blew this year. More money will be needed to be spent on the football program, more equipment will need to be purchased, and more thug coaches will need to be hired. This money will come from either a tax increase or cutting out more sports programs that our great AD doesn't care for.

But don't say a negative word about the football team, regardless of the ganster like atmosphere that has been allowed to take over this program.

It is your contention that you knew nothing about the Charlie Rogers incidents. When he came up for approval for a coach as either a volunteer or as a paid coach, you should have been aware. You must have been the only one in town that didn't know about the incident and the cover up. While you can deny you didn't know, it was your position to approve him and that put our students in contact with such a person. You should have been made aware of the circumstances and maybe our athletes would't be acting like thugs and being unsportsmanlike. Is it still your contention you didn't know?

Hey there. I just read all the posts. School, fire dept, polce dept. I used to live in Matawan a friend told me to read this. I only know what the chief is going through in the newspaper. I assume the "Shaft" stuff is a reference to him. He rubbed me the wrong way many years ago. So I have my own opinion.
My question is: What did he do? Why did the Prosecutors Office suspend him?
You guys make me laugh with the posts, but has anyone said what he did, or is accused of? It cant be that bad if he has been suspended WITH pay for some time. What do some of you know that the newspapapers have not said?

Its inevitable. Crime will rise and service time will go down with police layoffs. Look at the cities already and that pretty much is after announcements. I believe 4 car jackings in Newark, someone stabbed on the city hall stairs in Trenton (Mayor canceled the layoffs after this incident, Guess a little to close to home). Of coarse Keansburg from white trash, drunk, fighters to drug haven gangland. The money can be found in other places.
