At an open town meeting on December 16, 2014, the town
council told Mr. Rizkalla
- The township’s million dollar water project did not cause flooding in his house
- Had two experts visit his house who “cannot tell us anything the Township did is causing water in your basement”
- Will not release the reports of those “two experts”
- Offered Mr. Rizkalla $19,000 to go away
- That he’s welcome to get a lawyer and sue
The township is blocking disclosure of the engineer reports based upon the reports are protected “work product” prepared in anticipation of legal action. Fair enough. The reports probably are “work product.” However, in our country, the government works for us. Governmental institutions don’t enjoy the same rights to privacy as individuals. Freedom of Information Laws and the Open Public Records Act codify the public’s right to government records with certain exceptions.
Work product is a limited exception. As the town attorney surely
knows, on July 21, 2014, in Martin E. O’Boyle v. Borough of Longport, the
Supreme Court of New Jersey affirmed the public’s “common law right of access”.
The court further held as follows:
The attorney-client privilege shields the disclosure of documents otherwise accessible under OPRA . . . In order to determine whether the common law right of access applies to a particular set of records, a court must first determine whether the documents in question are public records. Second, the party seeking disclosure must show that he has an interest in the public record. If the record is privileged, the requestor must articulate a particularized need. Finally, once an interest is established, the burden shifts to the public entity to establish that its need for non-disclosure outweighs the plaintiff s need for disclosure. [Emphasis added]
The engineer’s reports are plainly public documents. Mr.
Rizkalla has a “particularized need” in knowing if the township turned his home
into a fish tank before he spends $100,000 to remediate the basement. Mr.
Cannon, an attorney and town council member speaking on behalf of the town
council, stated emphatically that the engineering reports do not show the
township has any liability.
If so, how can the public’s need for non-disclosure outweigh
Mr. Rizkalla’s need to know?
And that’s the crux of the matter. Mr. Rizkalla has the law
on his side but the township has taxpayer money. The council can spend hundreds
of thousands of taxpayer dollars on legal fees and stretch the court battle
over years. Mr. Rizkalla cannot.
Mr. Rizkalla is not a rich man. Mr. Rizkalla’s home is
flooded and likely has mold issues.
So the town council, acting on behalf of the public’s welfare,
offers Mr. Rizkalla some money and tells him to take it or sue.
Welcome to the bully pulpit.

I went out and found this water project and can see the problem firsthand. There is very little water in this entire thing. Talk about being over engineered *pun intended of course you'd think this thing was for serious water run off like we get over here in the beach. Awoken this morning when a neighbors house unfortunately caught fire. Our fine and brave police officers and fire volunteers were quick to respond. A big thank you to our first responders.
When you don't want to raise taxes during a big campaign year you raise other service costs or fees often not seen as a tax. Then your and other communities leaders secretly siphon off the needed money from those service or operational budget deficits in typical back room deals hidden too often from tax payers.
All you have to do is look at the salaries at just the top 5 employees managing your town or heading up various departments from what I see from your towns website.It is more than $750 thousand dollars for those top 5 alone.
More seriously and all too telling of your towns financial problems is your local police force's top 10 employee costs as one example. Those 10 with benefits easily totals over $1.775 million alone with the other police employees total with benefits near $1.8 million. That is over $3.575 million alone for what seems to be 32 employees plus or minus. Additionally from a cost savings possibility is that your town leadership has not switched over to the Monmouth County Police and Emergency Services Dispatching Service. That says much of the probable financial mismanagement from serious possible savings from that one step being overlooked or ignored.
I know these financial numbers are approximations that come from info supplied by your town. Information that is always questionable citing the source. The real problem in such a quick analysis is the creative budgetary processes and true operational costs that so often get moved around while hiding the truth of deficits and other cost negatives.
From your latest yearly appointments of your outside professionals listing alone your town even listed a financial advisor being appointed this year. A financial advisor for a town your size is a very serious sign of mismanagement practices or worse within your town offices or its political leadership. The often historic reality when you add the topic of a financial advisor along with the reported depleting of the towns surplus accounts is often a very dire sign for the towns financial future. That is another tell tale sign of very serious leadership inadequacies most often secretly and negatively affecting your towns daily finances and future sustainability. As my mentor says often "just because they are elected to office does not make them experts in everything". Your town has some very serious financial difficulties ahead despite what your politicians next campaign rhetoric will show. All is not right in your community finances.

Aberdeens 4m police force recent activity blotter disclosed that they responded to 285 calls for service of varying types. 211 of these calls were motor vehicle stops and issuing of tickets. 74 other calls during the same period of time for 4m dollars. 211 traffic summonses leaves an awful lot of time for doing what if 211 of these stats were pulling cars over. I don't get it and it screams for an analysis of the entire department and who is doing what and who is doing very little citing such an outrageous cost to us tax payers.
Freddie Gray the man who died that sparked the rioting and looting was arrested 20 times sine 2008. Did the police make him do it or did they arrest a thug criminal hurting and dealing drugs within his own community?

Surprised to see that Aberdeen Police Dept. still has a Police Blotter since we do not get anything from the town via e-mail as we used to.
Even more surprising is that it states they had 74 various incidents and 211 vehicle stops.
Where and when do these stops take place?
We never see a cop car around any more in or near our neighborhood so we wonder where are they?
Pulling a car over is a number to make people think they are doing something. Issuing a ticket is probably a mandated quota system. That leaves various calls totaling under a hundred that leaves a lot of time to do what exactly.
These people don't care anything about us at all. Recently some of us went over to a meeting and told our story to the mayor. No matter what we said nothing will changes we said as we left the building. All we wanted was a little help and understanding. We also did the just thing and told about the drugs and depress. We will see what happens and pray on our problems at church this week.

The old factory by town hall for seniors studied every campaign year after campaign year and nothing built after 15 years of demo lies from den bums.
The taxes are going up in corrupterdeen according to my paper read today. Like that has never happened before. It says the police budget is going up the most. Taxes getting raised again under the democrats and I think I know the answer to the question I asked myself when I read the article announcing the tax raise and *if the town leadership looked for savings like Coach Martucci said *under every nook and cranny first. Well, that should do it. If these cameras are the end-all to making people behave better through transparency and accountability, then we should be outfitting politicians as well. It's amazing we can find all this money for things like this and campaigning and studies, etc., yet we still have homeless and hungry people with no health insurance. I write having read the letter she submitted that while I myself as a professional Police Officer agree with much of what this writer stated for the most part. The Patch shows that our local police responded to 370 calls for service recently? Of those 192 out of the 370 calls for service were 110 motor vehicle stops that resulted in 82 tickets being issued. Maybe it is me? Why are motor vehicles stopped by a cop listed as a call for service and then likewise that same driver being issued a summons from being stopped is another call for service number. Aren't police supposed to stop drivers and issue tickets while riding around? Is it me or is our police communications person releasing the information to the press really padding the numbers?
Lucky for the idiots that are our mayor and town council that their attending of a council meeting isn't publicized similarly as a call for service like the police statistics are publicized. The mayor and council would only get one call for service and nothing else for taking any action like the police that resulted in any action. Know why that is my fellow oppressed Aberdeen taxpayers? It's really because they do nothing as a mayor and council. We all know they do nothing and sadly they all know it as well. After all they're democrats and all you have to do is look around.

Still not a ticket as I go to my car tonight and none of us commuters are complaining. Maybe the town got smart and just is planning on raising the parking costs on us and did away with the ticket person. Their are an awful lot of people in the recreation department when we obviously have little for them to do when you look at the recreation opportunities we have in town. I mean our league runs itself and the janitors at the schools open the gyms. So what are we paying all those people for?

Business lunch today in the Highlands I had to attend for work and it seems theres a pink coloring of all local businesses with signs everywhere. Looks to be a town wide thing going on to raise money and awareness. I guess when towns change the name of the town temporarily for a good cause our towns leadership don't want to compete with Corrupterdeen being the name of our town because of their political hi-jinx and criminal actions against all of us.

Happy Memorial Day to all my fellow oppressed taxpayers here in corrupterdeen. If you have nothing to do on monday you could go to town hall and see the Memorial Day ceremony. For some reason that befuddles me somehow honoring veterans isn't the thing to do. For some reason every Memorial Day our elected assholes put a big thing together to honor the police force and towns emergency volunteers. Why this town doesn't have a Volunteer Day and put more effort into honoring the people who Memorial Day is truly for amazes me. I guess reaching out to veterans of the armed forces don't get enough votes for the corrupt politicos. This town is ridiculous without a doubt. Don't get me wrong I appreciate the emergency service people but have a volunteer day if you want to honor them not on Memorial Day to get votes.

Looks like Chief Powers forgot to mention that we of the Aberdeen-Matawan Community Emergency Response Team were present and provided assistance at the unfortunate fire scene at the Ken Gardens apartment complex. While Chief Powers mentioned the fire services and other responding Emergency Services our contribution was not included in his press release.
Another multi unit apartment fire in town I hear? Looks like people need to be more careful to me. Is the town doing anything for these people? I never heard if the town organized anything for the one in late 2014.

Memorial day is for veterans you morons on council. It is not to recognize volunteer services to the community just for a headline and way to many pictures taken by the connected to a councilman family hire media person. I would be the first to attend a volunteer recognition day I can assure you so you morons on council that do anything for a vote so it don't surprise many of us who vomit at the thought of another day of democrats in office here in town. All of you do nothing like these people say and the proof is all around us.
